The National Aboriginal and Torres Strait Islander Legal Services (‘NATSILS’) and the Justice and Equity Centre (‘the JEC’) have received expert legal advice about the Australian Government’s power to make laws using its “external affairs” power under the Australian Constitution that gives effect to the Convention on the Rights of the Child, that would override state or territory laws that are inconsistent.
